
POSSIBILITY FOR PRIVATE COMPANIES TO SELL WATER TO SANITATION COMPANIES
Since 2020, the legislation on Sanitation considers alternatives so that the sanitation service providers (EPS) can complement and even expand the coverage of their drinking water supply and wastewater treatment services, with the participation of private companies. The Vice-Minister of the MVCS, Javier Hernández, in a recent interview mentioned that one of these alternatives is that the EPSs can contract water treatment, pay for volume and quality delivered for distribution to citizens, transferring to the private companies the risks and costs associated with the treatment technology applied. To achieve this, it mentions that Title IX of the Framework Law for the Management and Provision of Sanitation Services, approved by Legislative Decree No. 1280, should be modified. The modification would consist of unifying the contracting period for drinking water supply services and wastewater treatment to 25 years, after which the infrastructure developed for treatment would be transferred to the EPS. This would make the infrastructure permanent and not temporary. At present, this proposal was agreed upon by the Congress of the Republic and was able to advance in the Housing and Construction Commission, only awaiting approval by the Plenary.
